A Bexar County assistant district attorney has been fired following an incident in which she was mentioned in a friend's driving while intoxicated arrest report for advising him not to submit to a breath test.
Tara D. Richardson, who had worked as a misdemeanor family justice unit prosecutor for less than a year, also “flashed her badge” during the May 25 encounter, according to theSan Antonio Police Department document.
Even the DA's know not to take a breath test. In addition, most police officers would tell you the same thing. As of 2013, most large cities in Texas have implemented "no refusal weekend." What is a no refusal weekend? It is pretty much exactly what it sounds like. The police hare probable cause to arrest, they will ask you if you will submit to a breath test. If you refuse to submit to the taking of a breath test, the police will present a search warrant to the Judge on duty. If the warrant provides probable cause, the Judge will sign the warrant and the police will take your blood.
